It appears to the Court that the object of this case is to quiet title to, and remove a possible cloud upon, certain real estate located in Patrick County, Virginia. The property in question contains approximately seven acres located on and along Big Dan River which property was originally described as containing ten acres as follows:
BEGINNING at a Dogwood and spruce pine a corner to lands of James C. Dalton thence N. 6-1/2 ° W. 80 poles to a chestnut below a large rock near the Puckett field, thence S. 86 ° W. 6 poles to the bank of said river, thence with said river bank, down stream, to said James C. Dalton's line; thence with said Dalton's line to the beginning and containing ten acres of land meaning hereby to convey the same land which was conveyed to A.A. Rorrer, now dead, by C.W. Rakes and wife by deed dated September 1, 1910, and of record in the Clerk's Office of said Patrick County on the 5th day of September, 1910, in Deed Book 38, pages 50 to 51 and to which deed reference is hereby made for a further description of said lands.
The property in question was owned by Martin Fillmore Clark, Sr. at the time of his death on December 24, 2010. It appears to the Court that the property was conveyed by the heirs of A.A. Rorrer to D.T. Boyd by deed executed July of 1914 and recorded in the Patrick County Circuit Court Clerk's Office on April 29, 1951 in Deed Book 98 at Page 175.
It appears that one of the heirs of A.A. Rorrer, Belle Rorrer Marshall, did not sign the deed.
NOTICE is hereby given to Belle Rorrer Marshall and to the heirs of Belle Rorrer Marshall and to any unknown parties claiming by or through Belle Rorrer Marshall that the Plaintiffs claim in this lawsuit that neither Belle Rorrer Marshall nor any of her heirs nor any party claiming by or through or from her has any claim or right, title or interest in and to the said property.
NOTICE is further given to Belle Rorrer Marshall, to the heirs of Belle Rorrer Marshall and to any persons claiming by or through or from Belle Rorrer Marshall that in order to assert any claim, right, title or interest in the property that a notice of such claim shall be duly filed with the Circuit Court of Patrick County on or before January 6, 2014.
